Probate - why does it take so long

So my lovely hubby died in July. I spent nearly two months sorting out the paperwork for probate but managed to get it sent in early Sept. Apart from a short email to say they had received the paperwork a week after I submitted it, I still hadn’t heard anything back from them.

So I rang yesterday morning and the person confirmed that it was still in process!! That’s 9 weeks todate! I aske the call centre person when I could expect to hear anything and he couldn’t give me a straight answer. I just don’t know why it has to take so long.

Is this normal?

Hi adelou. So sorry for your loss . from when my husband died last April we filled the probate forms in in May last year we finally got the probate this May that has taken a year! I do hope that yours comes a lot quicker than mine did. Take care.

I managed to do probate myself. Once I had the email saying they had received the paperwork l just sat back and took the time to mentally rest for a while. I was told it could take anything from 6 weeks which was roughly how long it took.

I think it depends how busy they are at that time.

Unfortunately the Covid situation has caused a lot of delays, at least that is what we have been told. My mother in law died last November. Her 3 sons were her executors, with a sollicitor acting for them. Probate was only granted a few weeks ago.

I have a solicitor acting on my behalf. Husband died September 2020 but Inquest was not held until May of this year and death certificate issued. A number of the pension companies have still not replied. I got frustrated the other day and rang the pension companies myself only to be told that I would have a reply by the end of that week. That was two weeks ago. Probate cannot start until they reply. I have concluded they don’t care that this leaves us hanging, they want to keep a hold of the money. This is my experience only and hopefully others will have been dealt with more empathy to the situation.
