Probate

Government website on inheritance tax

This is what it says on gov web site

There’s normally no Inheritance Tax to pay if either:
: the value of your estate is below the £325,000 threshold
: you leave everything above the £325,000 threshold to your spouse, civil partner, a charity or a community amateur sports club

So it looks like if you are the wife and everything goes to you ,you won’t pay inheritance tax. I believe you put the value of the house as it would be now if you put it on the market , if you owe a mortgage I would think that would go under debts. This is only my understanding of it so may not be correct ,citizens advice should help and there should be a help number on the probate form itself only they do take ages to answer. I am presuming he left a will or it would be more complicated. Good luck .

I believe if the house is solely in his name you put the current market value of the house, they suggested that I get an estate agent to value it but the lady next door had sold hers a couple of months previously so I used that, the. remaining mortgage under debts and they will minus that off. Don’t half it, our mortgage was in joint names so that’s why I halved it.
I know it’s hard, I thought I’d start to feel better after the funeral, but I think so much of my energy was going towards the funeral that afterwards I had nothing to concentrate on apart from my loss.

Estranged husband died in Aug… I have talked to a pribate lawyer because I don’t have the emotional energy to think clearly about doing it myself. . But the questionaire for lawyer has been rough. Much.info I didn’t have. Still working on it pretty much. It is emotionally draining.

It is draining, especially when your mind is elsewhere and grief is so tiring. You just have to take it one step at a time, do you have a friend or family member who can help. I had no one to advise me but luckily I dealt with most of the finances so know most of the things needed, good luck x

Thanks. No one to help. My finances have been mostly separate from his for years. It’s been a challenge.

Hello, I had to apply for probate following my wife’s sudden departing. I managed it myself and was eventually successful but it dragged on for 11 months. I would suggest you use a probate specialist.

Thanks, Mike. I have a Probate lawyer but am still gathering information for her and doing lots on my own. Your statement about 11 months makes me feel SO much better. I have felt like I was lagging behind so long. It’s been 5 1/2 months. I’ll stop making myself feel bad about the time it’s taking me.
