Nigel, I honestly don’t know what she will do if she doesn’t get a copy of the Turkish Will, she is certainly not named on any of the Wills. And good luck if she tries to find where mine is, Turkey is a massive country. The courts have accepted the Will, it’s done, she can’t change their decision. She would need to appoint a Turkish lawyer and possibly a Scottish one but they have no Authority over Turkey. We are not talking a lot of money here, she is doing it to stress me out which she is succeeding, how can someone you have never met do this to a grieving widow? The way my Scottish lawyer wrote she has been sending quite a few letters to them, she probably thinks by giving her a copy will stop her pestering them. Well not on my watch, she is getting no more information. What can she do, take me to court for not giving information or is she chancing her luck thinking I’ve got a lousy lawyer which I would have to agree with. Complaint will also be going into the Law Firm. I will be changing my PoA and new Will to a different company. :muscle:

Nigel, anyone in this country can obtain a copy of a Will, but they have to pay for it. My lawyer talked me into giving her a copy for free as she said it would just make her angry not to let her see it. I don’t think that’s the case in Turkey as only the lawyer will have a copy and it’s a hand written will and only the courts can stamp it to approve of it, which has been done now.
Why do they make the law so difficult in some cases and easy in another.

Lizzy - I am sorry you are having to deal with these idiots. Tell me who they are and I’ll send the boys round. Its a shame you didn’t get to talk to them because they soon forget an email but a Scottish Woman in full rant is a spectacle to be amazed at. Hopefully they will all get their comeuppance. Reinterate that you wish to make that womans life as difficult as possible and to mark your file with that.

My day has improved. I went for a walk, I thought the cold air might help my head. It didn’t, but what I did see was loads and loads of tiny white feathers. Everywhere I walked I kept finding more. I then went to do some shopping and I found that Caramacs are back. I couldn’t believe it. It may not be big things but it made me a little happier.

I know they say that you grieve for life but what I am hoping for is that the moods swings reduce. Some days you don’t want to get out of bed then another you tackle the day head on with gusto. There is no predicting what day will be what.

Debsie, never mind sending the boys in, the mood I am in I could deal with them myself 5’0” and able for lawyers and this excuse of a human being. I could kick KtG’s vase to the moon with the way I’m feeling. Maybe I should go to the tip, the energy I have just now would lift all those heavy bags in the car no bother. If I could just stop crying, angry tears today.
Wow, you got your wish with loads of white feathers, glad your day is getting better, mines can’t get any worse. I wonder when my lawyer will answer my email. Kinda dreading it already but I’m no pushover, fed up getting messed about by these people and I’m paying them which makes it worse.
Enjoy your day xxxx

Yes, I guess they can in Scotland Lizzy. Here in England no one can get a copy of Mary’s will as I have the original and only copy. It’s not been registered anywhere as I don’t need probate. There is no court to go through - nothing. The executors just have to do what the will says. France is more like Scotland by the sound of it, as the property there would be split 50% to me and 50% between the kids. I haven’t told the French authorities though - all that will do is cost me loads of money, when my own will leaves the house in France between the kids anyway. I suppose if someone were to challenge the will, they could do so through the courts. But in my case there’s no one in the wings that might have any chance of contesting it. I suppose I should tell the kids exactly what it does say though.

Why make things so difficult - we should be able to leave our own belongings to whosoever we wish - Battersea Dogs Home if we really wanted! That’s what a will is for!

So sorry it is just so really difficult and unfair in Scotland.

PS. Virtual white feather for you too.

Thanks Nigel.
My husband paid for his lawyer to have PoA over in Turkey, but then I had to pay when he died to give him PoA to enable him to work for me before the property could be sold. There are so many hidden things that I’ve found out since my husbands death. We had to have the Will registered when we made it in Scotland, but the law is so stupid. My neighbour next door to me died a few years ago and we had these people claiming the house was theirs, they changed the locks and in they went. They even came and introduced themselves, but told diff neighbours a different story. Seemingly they had an old bit of card that was scribbled that the neighbour left them the property. The lawyers working on behalf of the neighbours brother had to end up paying these people to give up the house. He hadn’t lived in it for years and it was run down, they couldn’t have lived in it. The lawyer and police asked us for footage of these scroungers to prove they weren’t living in it,
This went on for years, they cleared the house out and I bet they found a few treasures in it. But what a cheek anyone doing that. I have lost faith in all Wills now, but I know mine won’t have any issues. It will be watertight.
I thought having joint names on our house would have been enough but not so. The sooner this Grant of Confirmation is granted the better. A lot of my friends have already changed their title deeds into their children’s names, seemingly it’s not as easy to do that now as the Gov. got wise to people doing this. Possibly tax reasons, I’m not sure.
I’d thoroughly check all the French rules carefully.
Even my friends are selling in Turkey this year as they both have health issues and don’t want the hassle that I have had. They thought just a Will would do but its clearly not.
Take care, I’m off to the tip now, feel you all have helped me calm down by ranting away. I’m ok again till the next email upsets me. Xxx

Here, wills are filed with the court when succession is opened and are public record. Seems to me the unknown step-child should request and pay for a copy from the court’s clerk. She is kinda saying “help me screw you out of money and assets that you and my dad collected during all your married life”.

Feeling lighter today. The weight of the courthouse run is off my shoulders.

Talked to my little friend with the heart issue. She is still on O2, and sounds a little congested, but said she is feeling better. Prayers answered.

Changing 3 lightbulbs and of course, broke one by dropping it. Installed one in a recessed can and it is so bright I was thinking “oh poop, I got the wrong bulb”, then I realized all the other bulbs are just dirty. They likely haven’t ever been changed as I don’t use overhead lights often. Project: take them all out, clean them and put them back. Oh joy! A chore I didn’t know existed has appeared.

There are 15 to clean and I have to use one of those poles with the suction cup to remove and replace them.

Oh, and the shedding has begun. The Beast is about to blow his coat for summer.

It is a beautiful day in the neighborhood. Except for the loud workers at the house behind mine.

All’s well. Love.

That’s all just so unfair and crazy Lizzy! If your friends put the property into their children’s names they may have to pay a market rent or they may be liable to tax. So yes if I were them I’d check that carefully. Everything is up in the air in France on property on death at the moment as the French say their law overrides an English will - even if you are not a resident in France. There’s a big court case going on which is another reason I don’t want to act now - as it might all change soon anyway!

Really glad you’ve been able to calm down Lizzy - I found that so hard the other day. The rant helps!

Much love xxxx

Nigel, it is very crazy,
My friends children will have to pay capital gains tax but they did it because my friends husband had to go into a home very early into his retirement and it turned out he was in the home for years. It saved them having to pay all the expenses when he died, she might have lost her home. They did take all his pension off him when he was in the home, it was a very difficult time for everyone and they had to act quickly while he was of sound mind. My other friend did it for another reason.
It’s sad, no-one knows what is ahead of us, I did not expect any of these problems when my husband died, we thought it was all in place. My lawyer has not answered my email yet, I just hope she hasn’t already given any information to the bitch. If she has I will be going to another lawyer to sue them.
Fighting Lizzy talking :muscle: xxxx

Yes, thanks Dave, for 75 I’m pretty fit and healthy - and with family all around me, I am almost too much looked after! Bless them, they so worry about me, being on my own, and they worry about the girl’s dad as well. He’s 76 and is not well at all. But he does still have his wife at least.
